The Elf on the Shelf® Influencer Giveaway Official Terms and Conditions

These Terms and Conditions govern “The Elf on the Shelf®Influencer Giveaway” (“Promotion”) and prevail in the event of any conflict or inconsistency with other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions. By entering this Promotion, all participants will be deemed to have accepted and agreed to be bound by these Terms and Conditions. Please retain a copy for your information. 

Sponsor: CCA and B, LLC d/b/a The Lumistella Company, 3350 Riverwood Parkway SE, Suite 300, Atlanta, GA 30339. 

Promotion: The Elf on the Shelf®Influencer Giveaway will be conducted via Instagram in collaboration with influencer Ashley McLaughlin (@ashleym.mclaughlin), who will execute the Promotion on behalf of the Sponsor in accordance with the Sponsor’s instructions.

Eligibility 

  • This Promotion is open only to legal residents of the 48 contiguous United States and the District of Columbia, aged 18 or older at the time of entry (excluding Alaska, Hawaii, all P.O. boxes, APO/FPO/DPO addresses, and U.S. territories and possessions). 
  • This Promotion excludes employees of CCA and B LLC d/b/a The Lumistella Company (the “Sponsor”), their immediate families, its affiliated companies, distributors, agents, or anyone else professionally connected to the Promotion. 
  • Internet access along with a valid Instagram account is required. No purchase necessary. 
    • Entries are limited to one per person. Anyone attempting to circumvent this rule by using alternative details, including but not limited to multiple Instagram accounts, will be disqualified. 
    • Maximum of one prize package per person. 
    • By entering the Promotion, you agree that your entry conforms to the Entry Requirements as defined below and that the Sponsor, in its sole discretion, may remove any entry and disqualify you from the Promotion if it believes that your entry fails to conform to the Entry Requirements.
    • Entries that include incorrect details or are submitted on another person’s behalf will be deemed invalid and may be voided following verification of eligibility.
    • Numerous factors outside our control may affect the operation of Meta’s platform (Instagram). Continuous, uninterrupted, or secure access to the platform cannot be guaranteed.
  • Incomplete, illegible, misdirected, or late entries will not be accepted. Proof of posting or sending is not proof of receipt. No responsibility is accepted for entries that are delayed, incomplete, or lost due to technical reasons or any other cause.

Promotional Period

  • The Promotion is open from November 21, 2025, at 9:00am EST, when the giveaway post is first published, through November 28, 2025, at 11:59pm EST.

How to Enter

  • To participate in the Promotion, eligible entrants must:
    • Follow @elfontheshelf on Instagram;
    • Follow @ashleym.mclaughlin on Instagram; and
    • Comments on Ashley’s giveaway post and tag a friend they would like to read The Rise of Nicholas the Noble with.
  • Private profiles that cannot be verified will not be eligible. Proof of posting is not proof of receipt. Incomplete, late, or ineligible entries will not be accepted. No purchase is required to enter or win.

Entry Requirements

  • Your participation must not include or link to any content that:
  • Contains defamatory, malicious, indecent, or otherwise inappropriate material;
  • Includes the name or images of any individuals without their consent;
  • Violates, infringes, or misappropriates the right so any other party, including copyrights, trademarks, privacy, or publicity rights; or
  • In the reasonable opinion of the organizer, may cause widespread or serious offense.
  • Entries or comments that violate these Terms may be removed or disqualified. Participants’ use of Instagram remains subject to the platform’s terms: https://help.instagram.com

Prizes 

  • Five (5) winners will each receive a price package consisting of:
    • One (1) Noorah plush; and
    • One (1) copy of The Rise of Nicholas the Noble novel.
  • Approximate retail value per prize package: $50 USD.
  • Prizes are non-transferable and non-exchangeable. No cash alternative will be offered. In the event of circumstances beyond its control, the Sponsor reserves the right to substitute a similar prize of equal or greater value at its discretion.

Winner Selection and Notification

  • Five (5) winners will be randomly selected from all eligible entries at the conclusion of the Promotion Period.
  • Prizes for four (4) winners will be fulfilled directly by The Lumistella Company.
  • One (1) winner will be contacted and fulfilled directly by the influencer, acting on behalf of The Lumistella Company in accordance with its instructions.
  • Winners will be contacted via direct message on Instagram and must respond within forty-eight (48) hours of notification to claim their prize. If a winner does not respond within this timeframe, the prize will be forfeited, and an alternate winner will be selected using the same method.
  • Please allow up to ninety (90) days for prize delivery, although Lumistella will endeavor to ship prizes within thirty (30) days of verification.

General 

  • This Promotion is in no way sponsored, endorsed, or administered by, or associated with Instagram or Meta. Participants acknowledge that Instagram and Meta bear no responsibility and agree to release them from any liability arising from participation in this Promotion.
  • Eligibility and entries may be verified, and any participant suspected of tampering or misconduct may be disqualified. The Promotion may be modified or suspended if necessary due to technical, legal, or other reasons beyond the organizer’s control.
  • No responsibility is accepted for the acts or defaults of third-party suppliers or agents, though reasonable efforts will be made to resolve any issues that arise.
  • All decisions regarding the Promotion are final.

Data Protection 

  • Personal data collected for this Promotion will be processed in accordance with The Lumistella Company’s Privacy Policy, available at https://www.elfontheshelf.com/terms-and-conditions#privacy.
  • Information may be shared with the influencer only as necessary to administer and fulfill prizes. Participants may request access to, correction of, or deletion of their personal data by contacting compliance@lumistella.com.

Limitation of Liability

Except for any liability that cannot be excluded by law, The Lumistella Company and its affiliates will not be liable for any loss, injury, or damage arising out of participation in the Promotion or the use of any prize.

Governing Law These Terms and Conditions are governed by the laws of the State of Georgia and subject to the exclusive jurisdiction of its courts.
